1. Accepting these Terms
These Terms of Service govern your access to and use of Regemify, including regemify.com and any Regemify mobile application or related service. Regemify is operated by Citrine South Bay 1243 LLC, doing business as Regemify, at 1968 S. Coast Hwy #1406, Laguna Beach, CA 92651. In these Terms, "Regemify," "we," "us," and "our" refer to Citrine South Bay 1243 LLC.
By creating an account, purchasing an item, connecting a seller account, posting content, or otherwise using Regemify, you agree to these Terms. If you do not agree, do not use Regemify.
You also agree to the policies that apply to your activity: our Privacy Policy, Regemify Protection and Refund Policy, Regemify Honesty Policy, What You Can Sell, Shipping Guidelines, and DMCA and Copyright Notice.
Transaction-specific information shown at checkout or saved with an order controls that transaction if it conflicts with general marketplace information.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a contract to use Regemify. Regemify currently supports United States buyers, United States shipping addresses, and sellers who can receive payouts through a supported United States Stripe account.
You agree to:
- Provide accurate and current information.
- Protect your password and account access.
- Notify us promptly if you believe your account has been compromised.
- Accept responsibility for activity conducted through your account.
- Not create additional accounts to manipulate reviews, evade restrictions, or mislead other members.
You may not transfer or sell your Regemify account without our written permission.
3. Regemify's role
Regemify provides a peer-to-peer marketplace where independent sellers offer physical items directly to buyers. Unless we expressly say otherwise, Regemify does not own, possess, manufacture, inspect, authenticate, pack, or ship listed items. Sellers remain responsible for their items, listings, packaging, and fulfillment.
Regemify charges buyers through Stripe using Regemify's platform payment account and later transfers eligible seller proceeds. This payment role does not make Regemify the manufacturer, owner, authenticator, or shipper of an item.
We do not guarantee that a crystal, mineral, treatment, locality, provenance, condition, value, metaphysical property, or other seller statement is accurate. Regemify Protection may apply if an eligible item is significantly different from its listing, but it is not an authentication or appraisal service.
4. Seller responsibilities
When you list or sell an item, you represent that:
- You own the item or are legally authorized to sell it.
- The item may lawfully be listed, sold, shipped, and possessed.
- Your photos and videos show the actual item being shipped.
- Your description, price, condition, measurements, origin, treatment, repairs, and material claims are accurate to the best of your knowledge.
- You clearly disclose known chips, cracks, repairs, treatments, synthetic or lab-grown status, and material safety concerns.
- You will package the item safely, ship it by the saved Ship by date, and provide valid tracking.
- You will comply with applicable consumer-product, labeling, recall, tax, export, wildlife, environmental, and hazardous-material laws.
- You will not make claims that an item treats, cures, or prevents a health condition.
Honest uncertainty is allowed. If you do not know whether a piece is treated, natural, lab grown, or from a claimed locality, say that you are not sure.
AI-generated or computer-created listing imagery is prohibited. Ivory, coral, or material from endangered species is prohibited. The complete rules are in What You Can Sell.
You must provide identification, bank, tax, contact, or business information when Regemify, Stripe, or applicable law requires it. You authorize us and our service providers to verify that information and to make disclosures about qualifying sellers when required by law.
Sellers are independent marketplace participants. Nothing in these Terms creates an employment, partnership, franchise, agency, or joint-venture relationship between a seller and Regemify.
5. Buyer responsibilities
Buyers are responsible for reviewing listing photos and descriptions, asking questions before purchase, providing an accurate shipping address, and safely handling purchased materials. After delivery, inspect the item promptly. Order problems must be reported within the deadlines in the Regemify Protection and Refund Policy.
You may not knowingly submit a false claim, misuse a payment dispute, falsely deny receiving an item, or use Regemify Protection to obtain an item without paying for it.
6. Offers and item availability
Offers are non-binding until payment successfully completes through Regemify. Sending or countering an offer does not place a card hold, pre-authorize payment, or guarantee that the item remains available.
An accepted single-item offer does not reserve or hide the listing. A seller cannot accept a second unpaid offer for the same item while one is already accepted. Other buyers may still start checkout at the listed price while the accepted offer remains unpaid. The first payment that successfully completes wins the item. If another payment completes after the item has already been won, Regemify either automatically issues a full refund or places the payment under review until it can be safely reconciled. Refund timing depends on the payment provider. The item does not belong to any buyer until payment successfully completes. The buyer may cancel an accepted unpaid offer when that option is available.
A single-item offer sent by a buyer does not automatically expire. A seller's initial single-item offer expires 48 hours after it is sent. Counteroffers in a single-item negotiation do not automatically expire. A bundle offer proposed by a buyer expires after 72 hours while awaiting a response, and a bundle offer proposed by a seller expires after 48 hours. An offer may become unavailable earlier if it is canceled or declined, or if the listing is sold, removed, changed, or made ineligible before acceptance.
Regemify rechecks price, availability, seller eligibility, shipping, and accepted-offer details when checkout begins and before an order is finalized.
7. Prices, fees, and payment
Sellers set their item prices and shipping charges, subject to marketplace rules and accepted offers.
Listing is free. Regemify's platform fee is 12% of the item price plus the shipping amount on a completed sale. The seller keeps 88% before any refund, shipping-label cost, postage adjustment, or other authorized deduction. We will disclose a materially different fee before it applies.
Buyers pay the item price, seller-set shipping, and any other amount clearly shown before payment. Regemify currently charges no separate buyer platform fee.
Payments are processed through Stripe. Additional payment methods, including digital wallets or buy-now-pay-later services, may have their own terms and eligibility requirements.
8. Stripe seller accounts
Seller payment and payout services are provided through Stripe. By connecting or continuing to use a seller payout account, you agree to the Stripe Connected Account Agreement, which incorporates applicable Stripe terms.
You authorize Regemify to:
- Create or connect a Stripe account for your Regemify seller activity.
- Share seller, transaction, order, refund, and payout information with Stripe.
- Receive account, verification, capability, risk, balance, and transaction information from Stripe.
- Request and manage the Stripe capabilities needed for Regemify payouts.
- Initiate, delay, reverse, or adjust transfers when required to complete orders, issue refunds, address disputes, correct errors, or comply with law.
- Communicate with Stripe about your connected account and Regemify transactions.
You must provide accurate information to Stripe and keep it current. Stripe may require additional verification, restrict an account, delay a payout, or stop providing services under its own terms.
9. Seller payouts, holds, and adjustments
For new orders, a seller payout normally becomes eligible for release five days after verified delivery and order completion.
Eligibility does not guarantee that the seller's bank will receive funds on that date. Stripe processing, weekends, bank timing, account verification, tracking problems, refunds, payment disputes, suspected fraud, legal requirements, or an open Regemify review may delay a transfer or bank payout.
A buyer help or refund request pauses the seller payout while the request is reviewed. Rejecting a request returns the order to its normal payout timing and does not create an immediate payout.
If Regemify issues a refund or incurs a payment reversal connected to a seller's order, the seller authorizes Regemify and Stripe to reverse or reduce an unpaid transfer, reverse an eligible prior transfer, or offset the amount against funds otherwise payable to that seller, to the extent permitted by law.
No interest is owed on amounts held for an order review or payout delay.
10. Taxes and required reporting
Regemify may calculate, collect, withhold, report, or remit taxes when we determine that applicable law requires it.
Sellers remain responsible for income taxes, business taxes, permits, registrations, and other obligations that Regemify does not expressly collect or handle for them. A seller must provide accurate tax information when requested.
Regemify or Stripe may prepare or deliver tax forms and report seller payment information to government authorities when required by law. Receipt or non-receipt of a tax form does not determine whether income is taxable. Regemify does not provide tax or legal advice.
11. Shipping and fulfillment
Sellers are responsible for safe packaging and shipment to the address saved with the order. Sellers normally have five business days after purchase to ship. If Vacation mode or another adjusted fulfillment date was disclosed before payment, the order's saved Ship by date applies.
Valid tracking is required for every order. Late, false, recycled, or unverifiable tracking may delay payout and result in account review. Regemify currently supports shipping only within the United States.
12. Regemify Protection, refunds, and cancellations
Regemify Protection is the order-support process described in the Regemify Protection and Refund Policy. It may cover eligible orders that were never shipped, lost in transit, damaged during shipping, or significantly not as described. A real person reviews each eligible request, and Regemify may issue a full refund, partial refund, or denial based on the available evidence.
For a delivered order, the buyer must report an eligible issue within three days of verified delivery. Every request also has a hard cutoff of 30 days after shipment, or 30 days after purchase if the item was never shipped.
Unless applicable law requires otherwise:
- Buyer's remorse and changes of mind are not covered.
- Regemify does not offer ordinary returns or exchanges.
- Buyers are not asked to mail an item back as part of the current Regemify Protection process.
- Approved refunds return to the original payment method and may take additional time to appear.
Regemify may cancel or refund a transaction when necessary because of fraud, payment failure, listing ineligibility, seller nonperformance, duplicate fulfillment, legal requirements, or a material marketplace error.
13. Reviews and user content
You retain ownership of the content you submit, including listing text, photos, videos, audio, profile information, and reviews.
You grant Regemify a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and promote that content as reasonably needed to operate, improve, secure, and market Regemify and your public listings. This license allows us to resize images, create previews, and display public content across Regemify surfaces and Regemify marketing.
This license does not transfer ownership of your content or prevent you from posting an honest review. We will not remove or penalize a review merely because it is critical or negative.
We may remove content that is fraudulent, abusive, threatening, defamatory, irrelevant, unlawfully discriminatory, sexually explicit, infringing, privacy-invasive, or otherwise violates these Terms.
Private messages are not licensed for public promotion. Authorized Regemify personnel may review them when reasonably necessary to provide support, investigate safety issues, prevent fraud, enforce these Terms, or comply with law.
14. Community rules and prohibited conduct
You may not:
- Threaten, harass, stalk, abuse, or unlawfully discriminate against another person.
- Post hate speech, sexual content, scams, spam, or another person's private information.
- Impersonate another person or misrepresent your identity.
- Manipulate reviews, likes, follows, offers, prices, or marketplace activity.
- Move a Regemify transaction off-platform to avoid fees or protections.
- Use stolen payment information or engage in fraud.
- Interfere with the operation or security of Regemify.
- Introduce malware or attempt unauthorized access.
- Scrape, crawl, copy, or automatically access Regemify without written permission, except through authorized search-engine activity.
- Use Regemify content, member information, or communications for unsolicited marketing.
- Use the service for an illegal purpose or to violate another person's rights.
15. Intellectual property complaints
Regemify respects intellectual property rights. If you believe content infringes your copyright, follow the instructions in our DMCA and Copyright Notice. We may remove or restrict disputed content and may suspend repeat infringers when appropriate.
Regemify's name, logos, designs, software, and original marketplace content are owned by Regemify or its licensors. These Terms do not give you permission to use Regemify branding or proprietary technology outside ordinary use of the service.
16. Account restrictions, suspension, and deletion
We may hide content, pause listings, restrict features, hold payouts, require corrections, suspend an account, or terminate access when reasonably necessary to:
- Enforce these Terms or marketplace policies.
- Protect buyers, sellers, Regemify, or the public.
- Investigate fraud, safety issues, or unlawful activity.
- Respond to a payment provider, carrier, court, regulator, or law-enforcement request.
- Address an unacceptable legal, financial, or security risk.
Whenever practical, ordinary listing problems follow the correction and warning process in the Regemify Honesty Policy. Serious conduct, including fraud, knowingly selling fakes, threats, harassment, or ban evasion, may result in immediate action.
You may request account deletion through Regemify. Active checkouts, unpaid accepted offers, unresolved orders, refunds, disputes, investigations, or legal obligations may delay deletion. Certain transaction, fraud, tax, refund, dispute, and legal records may be retained or anonymized as described in the Privacy Policy.
Termination does not cancel obligations connected to an existing order, refund, payout, investigation, or amount owed.
17. Communications and third-party services
You agree that we may send electronic communications needed to operate your account and transactions, including account-security, order, shipping, delivery, payout, dispute, refund, and legal notices. Optional promotional communications can be controlled through available notification settings or unsubscribe tools.
Regemify depends on third-party services such as Stripe, shipping carriers, hosting providers, email providers, image and video services, and identity or sign-in providers. Their services may be governed by separate terms and privacy policies. We are not responsible for an independent third party's systems or decisions, except to the extent applicable law provides otherwise.
18. Service availability and disclaimers
Regemify is provided on an "as available" basis. We work to keep it safe and reliable, but we do not promise uninterrupted access, permanent storage, error-free operation, or that every member will complete a transaction.
Except for the express Regemify Protection commitments and any warranties that cannot legally be excluded, Regemify disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Seller statements about authenticity, origin, treatment, condition, value, metaphysical properties, or safety are the seller's statements, not Regemify's. Buyers should seek qualified professional advice when identification, value, origin, or safe handling matters.
Nothing in these Terms limits rights or remedies that cannot be waived under applicable consumer law.
19. Limitation of liability
To the fullest extent permitted by law, Regemify will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, or lost data arising from your use of the service.
Except for obligations that cannot legally be limited, Regemify's total liability arising from a claim will not exceed the greater of:
- $100; or
- The amount you paid to or received through Regemify for the transaction giving rise to the claim.
These limits do not apply to Regemify's fraud, willful misconduct, gross negligence, or other liability that applicable law does not allow us to limit.
20. Indemnification
To the extent permitted by law, you agree to defend and indemnify Regemify and its owners, officers, employees, and service providers from third-party claims, damages, losses, and reasonable legal costs caused by:
- Your violation of these Terms.
- Your unlawful or infringing content.
- Your listing, sale, shipment, possession, or misuse of an item.
- Your fraud, intentional misconduct, or violation of another person's rights.
Regemify will provide reasonable notice of a covered claim and will not settle a claim in a way that imposes a non-financial obligation on you without your consent.
21. Governing law and disputes
Before filing a claim, please contact support@regemify.com and provide a short description of the issue and the result you are seeking. We will try to resolve it in good faith.
Except where applicable law provides otherwise, these Terms are governed by California law, without regard to conflict-of-law principles. Claims may be brought in the state or federal courts located in Los Angeles County, California. Either party may bring an eligible claim in small claims court.
22. Changes to these Terms
We may update these Terms as Regemify changes. We will post the revised Terms and effective date. We will provide additional notice and request renewed acceptance when a change materially affects member rights or obligations and applicable law requires it.
A material change will not retroactively change the rules of a completed transaction unless required by law or agreed by the affected parties.
If you do not agree to revised Terms, you must stop using Regemify and may request account deletion, subject to unresolved transaction and legal-record obligations.
23. General terms
If part of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision once does not waive our right to enforce it later.
You may not assign these Terms without our written permission. Regemify may assign them as part of a merger, reorganization, financing, or sale of the business, subject to applicable law.
Regemify is not responsible for delays caused by events reasonably outside its control, but this does not excuse payment, refund, privacy, or other obligations that applicable law does not permit us to avoid.
These Terms and the incorporated policies form the agreement between you and Regemify concerning the service.
